Terms and Conditions - Graphic/Textile/Illustration Design

Payment Terms
All payment accounts must be settled in full prior to the release of the files to the client.

Design samples
“The Client”also agrees to allow Kalaii Creations to showcase any/all work created in the course of a project as part of Kalaii Creations portfolio and Instagram Account Management. Kalaii Creations acknowledges
the confidential nature of projects and agrees to only display project work once product/site has been publicly launched/commences.

Fees for service
It is agreed that the fee for service shall be the cost estimates provided via email, unless work undertaken exceeds work outlined. If work undertaken exceeds the items specified in the quote, “The Client” agrees to pay appropriate fees for the excess work, outside the scope of the original agreement. Where ever possible
the client will be notified of increases in the scope of the project.

Approval of Final Artwork
While Kalaii Creations takes all care to avoid errors, Kalaii Creations accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production.
It is the “Client” responsibility to proof read and approve all final copy before the production of artwork. The email verification of the Client’s representative shall be conclusive as to the approval of all artwork prior to their release for printing, implementation or installation. No refunds or reimbursements are given after a final approved design has gone to print due oversights by “The Client’s” proof reading. It is recommended clients purchase a small one off copy to review prior to ordering a large print run.

Print Returns And Refunds
It is agreed that the Kalaii Creations is not responsible or held liable for any errors contained in the final product after the final product has been approved by the client. Kalaii Creations will not be held responsible for any changes or amendment made after approval. It is the sole responsibility of the client to notify Kalaii Creations of any such errors during the revision cycle and before the final files have been generated.

Print – Colour Variations
With all printing there may be some colour variations from what you have seen on screen to what the final product looks like and previous orders. This is due to the nature of CMYK printing and bulk-run printing system. There will be no reprints at the expense of Kalaii Creations. It is recommended a small sample print is arranged by you to ensure print satisfication, prior to arranging a large bulk run.

Printer Requests and Updates:
We understand it can be difficult entering a new world, of printing and manufacturing, and learning all new kinds of jargon, and having to liaise between printers and designers.
Despite Kalaii Creations best efforts, and asking as many questions of our client at initial enquiry, from time to time, there may be miscommunications between, client & printer and in turn the designer. This may result in additional changes to artwork that may be required after files have been paid for by the client and already delivered by Kalaii Creations.

Kalaii Creations are happy to make necessary adjustments to artwork files, with the following notations:

•Where there has been an error on Kalaii Creations part, the updates and changes to artwork files, will be made at no cost to you.
•Where a change is required due to a miscommunication between client and printer, and incorrect information was relayed to Kalaii Creations, our standard hourly rate will apply. We thank you for your understanding in this matter.

Kalaii Creations, illustrations and textile designs remain the Copyright of Kalaii Creations under the Australian Copyright Act.
- Copyright and transfer of full ownership of design may be purchased as a separate higher cost and agreement.
